Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and AiR By Lexvor Inc. (“Lexvor,” “we,” “us”) covering your access to and use of AiR by Lexvor (“AiR” or the “Service”). By using AiR, you agree to these Terms.

Section 01

Acceptance & Eligibility

By creating an account, sending a message to AiR, or otherwise using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using AiR on behalf of an organization, you confirm that you have authority to bind that organization to these Terms, in which case “you” refers to that organization.

Section 02

The Service

AiR is an AI-powered personal assistant that you can reach over SMS, voice calls, email, and a web dashboard. AiR can answer questions, look things up on the web, manage tasks and calendar events, draft and send messages, and perform actions in third-party services that you choose to connect (such as Gmail, Outlook, Google Calendar, Microsoft 365, Google Drive, and OneDrive).

The features available to you depend on your plan and on the integrations you authorize. We may add, modify, or remove features over time.

911 & Emergency Calling: Important Limitations

AiR mobile is a wireless service that also supports WiFi calling. Emergency 911 calling works differently than traditional landline 911, and you should understand these limitations before you rely on it:

  • Register your address. 911 operators use the service address on your account to locate you and route your call. Keep it accurate and up to date. If your address is wrong or missing, emergency responders may be delayed or sent to the wrong place.
  • WiFi calling and 911. When you place a 911 call over WiFi, your location may not be automatically shared with the 911 operator. Be prepared to state your exact location.
  • Power and internet outages. 911 calling may be unavailable during a power outage, an internet or broadband outage, or if your device loses signal, battery, or connectivity.
  • Number transfers (porting). While a number transfer is in progress, keep your old line active. 911 and other calling may be limited until the transfer completes.
  • No guarantee. We do not guarantee that 911 will be available in every circumstance. Always keep an alternative way to reach emergency services, such as a traditional landline or another wireless phone.

By activating and using AiR mobile, you acknowledge these 911 limitations and agree to inform anyone who may use your line of them.

Section 04

Account Registration

You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at security@airbylexvor.com if you suspect unauthorized use.

Section 06

AI Output & Actions on Your Behalf

AiR uses large language models to understand your requests and generate responses. AI output may be inaccurate, incomplete, or out-of-date. You should review important information before relying on it, and you should not treat AiR's responses as professional legal, medical, financial, or tax advice.

AiR uses three AI providers, all under contracts that prohibit training on your inputs and outputs: Google Cloud Vertex AI (Gemini family, the primary assistant model), Anthropic (Claude family, the fallback), and OpenAI (Whisper for speech-to-text on incoming audio, plus text embeddings for similarity search). Per Google's API Services User Data Policy (Limited Use rule), data obtained from any Google Workspace API (Gmail, Calendar, Drive, Contacts) is processed by Vertex AI and Anthropic only. Section 07

Connected Accounts

You may connect third-party accounts (Google, Microsoft, and others) to extend what AiR can do for you. By connecting an account, you grant AiR permission to access that account using the OAuth scopes described during the consent flow and detailed in our Privacy Statement.

You can revoke any connection at any time from the AiR dashboard or from the third party's own account-management page. Revoking a connection disables the features that depend on it but does not delete data already stored in your AiR account.

Your use of any third-party service through AiR is also governed by that service's own terms. We are not responsible for the availability, accuracy, or behavior of third-party services.

Section 08

Acceptable Use

You agree not to:

  • use the Service in violation of any applicable law, regulation, or third-party right;
  • use AiR to send unsolicited messages, spam, phishing content, or any communication that violates anti-spam laws (including the TCPA, CAN-SPAM, GDPR, and equivalent regulations in your jurisdiction);
  • attempt to gain unauthorized access to AiR, other users' accounts, or any related systems;
  • interfere with, disrupt, or place an unreasonable load on the Service;
  • reverse-engineer, decompile, or attempt to extract the source code, model weights, or proprietary methods of the Service;
  • use AiR to generate or distribute content that is illegal, defamatory, harassing, hateful, sexually explicit involving minors, or designed to deceive others into harm;
  • use AiR to develop, train, or improve a competing AI product or service;
  • impersonate any person or entity or misrepresent your affiliation.

Section 09

Subscriptions, Billing & Refunds

Some features of AiR require a paid subscription. By subscribing, you agree to pay the fees for the plan you select on the cadence shown at checkout (monthly or annual), in the currency listed. Payments are processed by our third-party payment processor and are subject to its terms.

  • Subscriptions renew automatically at the end of each billing period until you cancel.
  • You can cancel at any time by contacting support. Cancellation takes effect at the end of the current billing period; you continue to have access until then.
  • Except where required by law, fees are non-refundable. We may, at our discretion, offer pro-rated refunds in cases of extended service unavailability or billing errors.
  • We may change pricing for new billing periods with at least 30 days' notice.
  • Taxes (VAT, sales tax, etc.) may be added where applicable.

Section 10

Your Content and Our IP

You retain ownership of the messages, files, and other content you submit to AiR (“Your Content”). You grant Lexvor a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely to operate and improve the Service for you. We do not use Your Content to train AI models or for advertising.

The Service itself, including its software, design, brand, and documentation, is owned by AiR By Lexvor Inc. and its licensors and is protected by intellectual-property laws. Nothing in these Terms grants you any right to our trademarks or branding without our prior written consent.

Section 11

Privacy

Our handling of your personal information is described in our Privacy Statement, which is incorporated into these Terms by reference. By using AiR, you acknowledge that you have read and understood it.

Section 12

Suspension & Termination

You may stop using AiR and delete your account at any time from the dashboard. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, are using the Service in a way that risks harm to other users or to us, or if we are required to do so by law.

Sections of these Terms that by their nature should survive termination, including IP, disclaimers, liability limits, indemnification, and governing law, will survive.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, LEXVOR DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE OR FIT FOR YOUR PURPOSE.

Section 14

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LEXVOR OR ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE TOTAL FEES YOU PAID TO LEXVOR FOR THE SERVICE IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY FEES IN THAT PERIOD, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Section 15

Indemnification

You will defend, indemnify, and hold harmless Lexvor and its affiliates from any third-party claim, liability, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service in violation of these Terms, your violation of any law, or your infringement of any third-party right.

Section 16

Governing Law & Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. The exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in Wyoming, and you consent to personal jurisdiction there.

Where required by your local law, this section does not deprive you of any mandatory consumer protections that apply in your country of residence.

Section 17

Company Relationship

Air By Lexvor Inc. operates independently but in partnership with Lexvor Inc., which provides telecommunications infrastructure, billing, and network compliance. All payments, credits, and partner integrations are administered under this relationship.

By using Air, you acknowledge that:

  • Air By Lexvor Inc. manages all AI and SMS systems.
  • Lexvor Inc. acts as a supporting telecommunications and network services partner.

Section 18

Rewards & Points System

Air’s rewards and points programs (“Air Rewards” or “Points”) allow users to earn and redeem value through eligible transactions. By participating, you agree that:

  • Points have no cash value and are non-transferable.
  • Points can only be redeemed within Air’s verified partner network.
  • Air may adjust, limit, or expire points in cases of fraud, misuse, or system error.
  • The value of points may vary depending on tier, spend level, or partner participation.
  • Rewards and credits are provided as discounts or promotional incentives, not as cash or refundable funds.

Air reserves the right to modify point structures, earning rates, or partner offers at any time.

Section 19

Partner Network & Third-Party Offers

Air connects users with partner businesses for shopping, bookings, and discounts. All products, services, and promotions offered by third parties are subject to their respective terms and policies.

Air By Lexvor Inc. and Lexvor Inc. do not guarantee, endorse, or assume responsibility for any third-party content, product quality, or fulfillment. Users are encouraged to review partner terms and confirm details before making purchases.

Section 20

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date and, where appropriate, notify you through the Service or by email before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
